Annex No. 1 BEE TALENTS INFORMATION CLAUSE – as a recruitment agency acquiring candidates for the client / building its own database

 

PERSONAL DATA CONTROLLER 

 

  1. The controller of your personal data is Bee Talents P.S.A with its registered office in Poznań ul. Królowej Jadwigi 43, 61-871 Poznań NIP:  7792463296 hereinafter referred to as “Controller”.

  2. Regarding the protection of your personal data, you can contact the Data Protection Officer at the e-mail address: iod@beetalents.com or in writing to the address of our registered office indicated above.

 

OBJECTIVES AND LEGAL BASIS FOR PROCESSING PERSONAL DATA

  1. Carrying out the initial stage of recruitment, based on your consents, including the personal data provided in accordance with art. 6 sec.n 1 point a) GDPR (ordinary data) or in accordance with Art. 9 sec. 2 point. a) GDPR (data of a special category, e.g., data on health or degree of disability);

  2. Participation in future recruitment processes conducted for our clients, based on the consent given in art. 6 sec. 1 point. a the GDPR.

  3. Defending against potential claims of our clients for whom we are recruiting, regarding the non-compliance of the Candidate’s profile with the requirements specified by the client – which is a legitimate interest of the data controller pursuant to art. 6 sec. 1 point F) GDPR.

 

 SCOPE OF PERSONAL DATA

  1. Scope of personal data: name and surname, date contact details (e.g. telephone number, e-mail address, contact via a social networking site, e.g. LinkedIn); education, professional qualifications, previous employment history and other data, usually e.g. photo (candidate’s image), interests, additional skills;

It may happen that you include data of special categories in the application (specified in Article 9 of the GDPR, e.g. regarding health or disability certificates – by providing them you consent to their processing by the data controller, but knowing that such data is not processed by us required.

 

SOURCE OF PERSONAL DATA

  1. We received your personal data directly from you, or we obtained it from your profile on LinkedIn.

 

DATA RECIPIENTS

  1. Your personal data may be transferred to processing entities that provide services to the Controller based on entrustment agreements concluded with him (IT service providers, including hosting and services supporting HR processes, as well as operators of recruitment portals).

  2. As a rule, your personal data will not be transferred outside the EEA or made available to international organizations. However, if the controller uses service providers from outside the EEA area, which have not been recognized by the European Commission as ensuring an adequate level of personal data protection, the transfer of personal data to the above-mentioned entities is carried out on the basis of standard data protection clauses, which ensure safeguards in the field of protection of privacy and rights and freedoms people whom applies to. A copy of the Standard Contractual Clauses can be obtained from the controller.

 

RIGHTS OF DATA SUBJECTS

  1. Access your personal data and request a copy of it;

  2. rectification of your personal data;

  3. Requests to limit the processing of your data;

  4. Data portability;

  5. Withdrawal of consents at any time,  whiteout affecting the lawfulness of the processing which was made on the basis of consent before its withdrawal;

  6. Deletion of data, if no other purpose of processing is carried out and there are no premises excluding this right, indicated in art. 17 sec. 3 GDPR;

  7. To object (related to the particular situation of the data subject) to the processing of personal data in the scope of the legitimate interest of the Controller

  8. Lodging a complaint to the President of the Personal Data Protection Office ( https://uodo.gov.pl ). 

 

PERIOD OF PROCESSING PERSONAL DATA

 

  1. The data will be processed until the end of the recruitment process, no longer than 12 months from the receipt of the candidate’s application by the Controller or for the period indicated in the possible consent for future recruitments (no longer than one year from the end of the recruitment process).

  2. In the case of data processed on the basis of the Controller’s legitimate interest, the candidate’s personal data is processed for the period of limitation of claims.
